1. Acceptance of Terms
These Android Terms of Use ("Terms") form a binding agreement between you and Peachy Technologies ("Peachy," "we," "us"). They govern your access to and use of the PeachyList Android application (the "App") downloaded from the Google Play Store.
By downloading, installing, or using the App, you agree to be bound by these Terms and by our App Privacy Policy. Your use of the App is also governed by Google's Google Play Terms of Service; in the event of a conflict, the more restrictive terms control with respect to Google's rights.
2. License to Use the App
Subject to your compliance with these Terms, Peachy grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Android-powered devices that you own or control, for your personal, non-commercial use.
You may not (and may not allow others to): copy, modify, distribute, sell, lease, rent, sublicense, reverse engineer, decompile, disassemble, or create derivative works of the App; use the App to build a competing product; or remove any proprietary notices.
3. Compliance with Google Play Policies
The App is distributed through Google Play and is subject to the Google Play Developer Distribution Agreement and the Google Play Developer Program Policies. We commit to operating the App in compliance with those policies, including disclosures around data collection (Data Safety section), in-app purchases, subscriptions, and content guidelines.
4. Eligibility & Accounts
You must be at least 13 years old to use the App (16 in the European Economic Area / United Kingdom). If you are under the age of majority in your jurisdiction, you must use the App with the involvement of a parent or legal guardian who agrees to be bound by these Terms.
You are responsible for keeping your account credentials secure and for all activity under your account.
5. Subscriptions & Google Play Billing
5.1 Free and Paid Plans
Most of the App is free to use. Peachy Monthly Subscription is a paid subscription that unlocks additional features. Current pricing, billing frequency, and free-trial details (if any) are shown on the Google Play store listing and within the App at the moment of purchase.
5.2 Google Play Billing
All paid subscriptions and in-app purchases for the Android App are processed by Google Play Billing under your Google account, in accordance with the Google Play Terms of Service. Peachy does not receive or process your payment card details for Play Store purchases.
5.3 Auto-Renewal
Subscriptions purchased through Google Play renew automatically at the end of each billing period at the then-current price unless you cancel at least 24 hours before renewal. You authorize Google to charge your Google Play payment method on each renewal.
5.4 Free Trials & Price Changes
If a free trial is offered, your subscription begins and is charged at the trial's end unless you cancel before then. We may change subscription prices; price changes apply only to future renewals and Google Play will notify you in advance.
5.5 Managing & Cancelling Subscriptions
You can manage and cancel subscriptions in the Google Play app: Menu → Payments & subscriptions → Subscriptions. Cancelling stops future renewals; you keep access through the end of the current paid period.
6. Refunds & Cancellation
Refund requests for Google Play purchases are handled by Google under Google Play's refund policy. You can request a refund through your Google Play account at play.google.com/store/account. For App-related issues that fall outside Google's refund window, contact us at SupportTeam@peachytechnologies.com and we will review your request.
7. Account & Data Deletion
You may delete your account and associated data at any time:
- From within the App: Settings → Account → Delete Account.
- From the web: sign in at peachytechnologies.com/account/settings/ and use the Delete Account option.
- By email: send a deletion request from your account email to SupportTeam@peachytechnologies.com; we will complete the deletion within 30 days.
Account deletion removes your shopping lists, preferences, and identifiable account data from our active systems. Backups containing your data are retained for up to 60 days and then permanently purged.
8. Acceptable Use
You agree not to use the App to:
- Violate any law or the rights of others;
- Upload, transmit, or store unlawful, infringing, harassing, defamatory, sexually explicit involving minors, or otherwise objectionable content;
- Distribute malware or attempt to compromise the App's security;
- Use the App to harvest data from other users without authorization;
- Resell, sublicense, or commercially exploit the App except as expressly permitted; or
- Modify the App or use it on a device that has been rooted or otherwise modified in a way that bypasses security or licensing protections.
9. User-Generated Content
The App lets you create and store content such as shopping lists, store data, and household / team data. You retain ownership of your content. You grant Peachy a limited, worldwide, royalty-free license to host, store, sync, and process your content solely as needed to operate the App for you. We do not sell your data, and we do not use it to train AI models that we do not control.
You are responsible for your content and for ensuring you have the rights to upload it.
10. App Output & No Professional Advice
- Any nutrition, health, or fitness information surfaced through the App is general information, not medical or dietary advice.
- You are responsible for verifying prices, ingredients, and any third-party data before relying on it.
11. Intellectual Property
The App, including all software, design, text, graphics, logos, and trademarks, is owned by Peachy Technologies or its licensors and is protected by intellectual property laws. Nothing in these Terms transfers any ownership of the App to you.
"Peachy," "PeachyList," and the Peachy logo are trademarks of Peachy Technologies. "Google Play" and the Google Play logo are trademarks of Google LLC.
11.1 Feedback
If you send us suggestions or feedback, you grant us a perpetual, irrevocable, royalty-free license to use it without restriction or attribution.
12. Third-Party Services & Data
The App integrates third-party services including Firebase / Google Cloud (authentication, Firestore, Cloud Functions, Crashlytics), Google Play Billing, and select data providers referenced inside the App. Third-party data is provided "as is" and we are not responsible for its accuracy or availability.
13. Export Controls & Restricted Regions
You represent and warrant that: (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties. The App may not be downloaded, exported, or re-exported in violation of any applicable U.S. or other export-control laws.
14. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. PEACHY DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEACHY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE APP. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID FOR THE APP OR IN-APP PURCHASES IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) USD $50.
16. Indemnification
You agree to defend, indemnify, and hold harmless Peachy and its affiliates from any claims, damages, costs, and expenses (including reasonable legal fees) arising from your violation of these Terms, your misuse of the App, or your content.
17. Termination
You may stop using the App at any time by uninstalling it. We may suspend or terminate your access if you violate these Terms or if we discontinue the App. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law) will survive.
18. Governing Law & Disputes
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws principles. The parties agree to exclusive jurisdiction in courts of that jurisdiction, except where mandatory consumer-protection laws of your residence apply.
You agree to first attempt to resolve any dispute informally by emailing SupportTeam@peachytechnologies.com before filing a claim.
19. Changes to These Terms
We may update these Terms from time to time. The "Last Updated" date above shows when. If a change is material we will provide reasonable notice (such as an in-app notice or Google Play update notes). Continued use of the App after the effective date means you accept the updated Terms.
